UK : Hutchison 3G UK Limited (“3”), the UK’s leading
mobile media company, today welcomed the ruling by the Competition
Appeal Tribunal (“CAT”).
The CAT handed down its decision in the case between 3 and the Office
of Communications (“OFCOM”). The decision annuls the significant
market power (“SMP”) designation made by OFCOM against
3 in June 2004
The decision is significant as it is the first occasion in the UK
that a telecoms operator has successfully appealed against an SMP
designation by the national regulatory authority.
