After my original N95 suffering water damage, i sent it off for repair or replacement with the warranty company.

Despite promising a 5 day turnaround it has taken almost 2 months to get my new handset. The policy does explain that it is NOT a new for old policy and you would get a new phone in similar condition to your old one.

During the phone calls over the last few weeks i was told that they had ordered a new phone and i would get it as soon as it came in. At the worst i was expecting a reconditioned one.

When it arrived today (no box etc ,just in a jiffy bag) it was obvious it has had a new cover fitted but the screen was filthy and there is a lot of wear and scratches to the camera surround on the rear.

it has V 20.0.015 firmware on, has internet settings for Vodafone, o2 and Orange as well as about 10 various named WLAN access points. It also has a Yahoo e mail account for someone called Mark Wi**son. To top things off it has a load of ringtones installed (e.g " My wife has a large fa**y" ) that my 10 year old son found a little shocking when he was going through them.

Surely this is incorrect of the insurance company? I can accept that i may get a second hand/reconditioned phone but i would expect it to have been wiped completely. It just seems strange that it has the latest firmware that hasn't been out that long yet still has loads of stuff on it.

My questions are

Why has someone up until recently been using the phone?
How have the insurance company ended up with it?
Why was it not formatted etc?

Oh and to top it off they never returned my charger or box i sent my old one off in. I will be ringing them in the morning but would just like a few opinions on what has happened.

I would also ring Trading Standards to see where I stand with the law so they dont try to pull the wool over your eyes:)

Tell the F*ckers that they will end up on Watchdog if you dont get some satisfaction. :dead:

What network are you on and who is your phone insured with?

It was on Vodafone who i originally returned the phone to only to be told by them it was water damaged and uneconomical to repair, even though to my knowledge the phone had never got wet.

It seems a less than honest employee at the insurance company liked the look of my new N95 and swapped it for his own !!
Problem was he left his yahoo email account on it !!

I am getting a New N95 delivered tomorrow and can check its in a sealed box etc before i accept it and return this one i have got.

I wont name the insurance company as they have dealt with it very well since my phone call and have assured me that as soon as they get the N95 back and can see proof of the email , IMEI number of the phone that the employee will be getting his P45.

So tomorrow hopefully it will finally all be sorted out.
