basically ive just entered into/renewed a 18 month contract with 3 about a week ago for a N95, only thing is ive moved house, had no internet and knew nothing concerning the 8GB N95.

Is there anything i can do to get out of the contract, i have the phone now for about maybe 10 days??

Check your contract. If you've had it for less than 14 days (depending on the network) you can cancel the contract.

i think you can only do that if youve not recieved or made any calls or texts or tacken any pictures

no, that's retailer instructions only. If you've done anything outside of your free allowance, the network just bills you for it.

3 say you can change your mind within 14 days provided you have not used the phone or put your sim card in.

Ive used the phone, i do remember something concerning me using the phone etc than i wouldnt be able to get out of the contract, so i have used the phone, can i still get out of the contract??

I don't think so. Have a word with someone in your local Three shop if you have one they will be able to tell for sure.

As far as I'm aware If you're within the 14 days grace period you should be able to cancel your contract regardless if you made/received calls or not.

Do it quick though ;)

I thought that the 14-day cooldown period was for mail order, not transactions made in person.. but you can try, yes.

When I was talking to 3 earlier in the week, they confirmed to me that once you have made a call sent a text or taken a photo you can not return the phone.

While they give you 14 days they are saying you can look at the phone but you can not use it.

That is an awful stipulation but thanks for clearing that up.

How do they expect you to check if you like the phone or not if you can't use its basic functions? call quality, camera quality, camera lag etc.

I was about to order a 6120 when I asked about their terms, I have put that on hold until I am sure I want the phone. In this case I have played with a 6120 on another network so I know its a phone I like.

It means you need to be 100 % sure that you want the phone you are ordering. It would appear that 3 are operating similar terms as when you buy a phone in a shop, in that you put the sim in the phone and its yours.

As buying on line or by phone it is covered by the distance selling regs they are saying you have 14 days to return the phone as long as it is as new and as sent to you.

When I was looking at the 6120 in the shop (dummy phone) you can't tell what its like to use. I just had a 6120 on T-Mobile and they gave me 7 days to use the phone as I wanted and I could return it if I wanted to.

As it turned out as I use the web and email I found that compared to my previous phone the screen was to small for my requirements and has been returned, with 3 I would have had with to keep the phone.

@lzyguy I would still give it a shot and try to return it... See what they say. Do a hard reset and get them to prove you actually used the phone. I know they can check up with 3 records of any calls you made but who knows they may not even bother... You could also argue that you used the sim in a different phone thats why there is no call logs, no last dialed number etc. on your n95. A long shot but worth a try.

even if you buy the phone on line you still cannot make or recieve any calls or texts etc. if you do this you cannot return the phone once you use it you are bound into the contract. i ordered mine on line and they made me aware of these conditions strait away and when the phone came these conditions were printed on the seal of the box.

It's not true that they will fall for the 'used sim in different phone' trick.

If they check your call records at their end it shows the IMEI number of the phone that was used to place any call. They may not be that anal but they have the facility.

I thought the 14 day cooling off period was a statutory thing that phone providers had no choice but to offer, whether you've used the phone or not. You could ask Trading Standards.

Well ive just ordered a 4 gig memory card so might just keep it since the get out clause dont seem to be very clear!!
