I have a Vario 2 which works intermittently. It shows good service levels but calls go straight to voicemail and the phone doesn't tell me I have missed calls. It finally lets me know I have voicemail much later - an example was 14 hours today.

I live in Leeds but for next 2 weeks I am working in Norwich and need a phone that works. I want to hand my phone into T Mob in Norwich and have it repaired and returned to Leeds. I am told this is impossible I have to collect it in Norwich. If the phone takes more than 2 weeks to repair I will have to drive 200 miles to collect a phone and then drive 200 miles back again. Systems don't allow any other solution apparently - it might get lost in the post and then where would we be?

My last T-Mobile repair took well over a month - in fact it never actually happened I rang them to find out if my phone was back they'd had it a fortnight and when I went to Manchester (from Leeds) to get it I was advised it actually couldn't be repaired but no-one had checked the paperwork. A potential drive to Norwich is not a risk I want to take.

I asked for a loan phone to see me through the next two very important weeks - and delay repairing the Vario which I would take back to Leeds in a fortnight and get sorted - again this is impossible, systems don't allow it - I suggested they take it hostage for 2 weeks and put it in a cupboard and then I'd pick it up and take it back to Leeds to be repaired. Systems don't allow it - if they take it in it has to be repaired. I asked them to just loan me a phone without taking the Vario. No can do - systems don't allow it they canm only loan me a phone if I give them one in return.

So I can either buy a pay as you go - and I resent giving T Mobile any more cash - or I have a crap phone service for 2 weeks (which I'm paying handsomely for).

Which do you recommend and will they sue me when I cancel my direct debit because they have singularly failed to assist me - will the system allow that?

Can't you get it repaired by HTC directly? 0120-271-4530 according to their site, worth asking.

Upgrading to Windows Mobile 6 may be the best way forward.

I believe there is supposed to be an 'official' upgrade but I've never found it. However, I upgraded to this 'unofficial' version some time ago and found it to be very stable.

It is also worthwhile searching for the latest radio ROM. some of the earlier ones were a bit flakey
