No 3.5G HSDPA on pay as you go, Is it only for contract customers only

If i use mobile web/wap or use phone as 3.5g modem it only works in 3g mode on my nokia n95 with pay as you go sim card in the phone it does not go in to 3.5g hsdpa mode like it does if i put my vodafone sim in the phone or on my friends t-mobile contract n95 in my house,

So is hsdpa 3.5g on t-mobile only for contract customers not pay as you go customer can so one confirm this or do i need to change any settings,
