Basically I bought a Nokia N95 the other day on a 18mth contract from the t-mobile shop. I have barely used it (not made any calls on it, just taken a few pictures and that's all) but now I have been offered a good upgrade offer from my current network. So I need to return the phone back. What is the returns policy? Everything is in the same condition as it was when I bought it.

If you brought it from a T-Mobile shop as far as I am aware there is no return policy. If you did the street check coverage check when you brought it you would have had a chance to return it. If not I may be wrong but I think you are now tied in to a 18 mth contract. This should have been explained to you at the time of purchase.
If you buy from T-Mobile tele sales/off the web you have the 7 day DSR to return it as well as the coverage checker if you choose to use it.
The street check coverage was done and everything came up OK. I think the guy did say there is no returns policy but there must be some way I can return it. Most networks have a 14 day cooling off period don't they?

from what i remember working at t-mobile, there is a 14 day return policy but only if you had a streetcheck done and you still experienced poor network coverage, then you could return the handset.
other than that, as far as i know it is at the manager's discretion.
good luck
So... can anyone suggest a way around this?

Perhaps you can make calls outside where you live but as soon as you go inside your unable to make calls. You could then return the handset.
